Welcome to The Backyard Carpenter Co. ("we," "us," or "our"). These Terms and Conditions govern quotes, estimates, contracts, and services provided by The Backyard Carpenter Co., as well as your use of our website, thebackyardcarpenterco.com (the "Site"). By requesting a quote, hiring us for a project, or using our Site, you agree to these Terms.

1. Services

The Backyard Carpenter Co. provides custom outdoor construction services, including but not limited to pergolas, decks, greenhouses, garden beds, and related backyard projects. The specific scope of work for your project will be defined in a written quote or contract provided separately from these Terms.

2. Quotes & Estimates

• Quotes provided are estimates based on the information and site conditions known at the time.

• Final pricing may be adjusted if site conditions, material availability, or project scope change once work begins.

3. Payment Terms

• 50% deposit is required to schedule and begin work on your project.

• Remaining 50% balance is due upon completion of the project.

• Late payment on the final balance may result in delayed project handoff or additional fees.

4. Project Timelines

• Estimated project timelines will be communicated prior to starting work.

5. Client Responsibilities

To keep your project on schedule, clients are responsible for:

• Providing clear access to the work area

• Notifying us of any underground utilities, irrigation lines, or private lines not covered by a standard 811 utility locate

• Removing personal property, pets, or obstacles from the work area

• Obtaining any required HOA approval prior to project start, if applicable

• Securing necessary permits, unless permitting is explicitly included in your quote

6. Change Orders

Any changes to the agreed-upon project scope — including materials, design, or added work — must be approved in writing (email or signed change order) before the change is made. Change orders may affect final pricing and timeline.

7. Warranty

We provide a 2-year warranty on workmanship from the date of project completion. This warranty covers defects in our construction work under normal use conditions.

This warranty does not cover:

• Damage from misuse, neglect, or lack of maintenance

• Normal wear and tear

• Damage caused by severe weather, acts of nature, or third parties

• Manufacturer defects in materials (these are covered separately under the applicable manufacturer's warranty, where available)

To make a warranty claim, contact us using the information in Section 12.

8. Cancellations

• Cancellations made before work begins may be eligible for a partial refund of the deposit, minus any costs already incurred (e.g., materials ordered, design time).

• Cancellations made after work has begun are not eligible for a refund of the deposit, and the client will be billed for work completed and materials used to date.

9. Limitation of Liability

The Backyard Carpenter Co. is not liable for:

• Pre-existing site conditions not disclosed prior to project start (e.g., unmarked utility lines, poor soil conditions, existing structural issues)

• Indirect, incidental, or consequential damages arising from the project

• Delays caused by factors outside our reasonable control (weather, supply shortages, permitting delays)

Our total liability for any claim related to a project is limited to the amount paid for that specific project.

10. Insurance & Licensing

11. Website Use

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas. Any disputes arising from a project or these Terms will first be addressed through good-faith direct communication. If unresolved, disputes may be handled through mediation or in a court of competent jurisdiction in Lamar County, Texas.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date.
